These Terms of Service ("Terms") govern your access to and use of FluxPulse, including our website, platform, agents, and services (collectively, the "Service"). By accessing or using FluxPulse, you agree to be bound by these Terms.
License & Acceptable Use
We grant you a limited, non-exclusive license to use FluxPulse in accordance with these Terms and our Fair Use policy. You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of our agents or platform
- Use the Service to monitor infrastructure you don't own or have explicit permission to monitor
- Use the Service for competitive analysis or benchmarking against FluxPulse itself
- Circumvent usage limits, rate limits, or authentication mechanisms
- Remove, obscure, or alter any proprietary notices or labels
Your Data & Responsibilities
You are responsible for all data you provide to FluxPulse, including server credentials, configuration, and monitoring targets. You warrant that you own or have permission to monitor the infrastructure you connect to the Service.
You are responsible for maintaining the confidentiality of your API keys and account credentials. We are not liable for unauthorized access resulting from your failure to protect these credentials.
Disclaimer of Warranties
FluxPulse is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. We are not responsible for data loss, system failures, or business interruptions resulting from the Service.
Limitation of Liability
To the maximum extent permitted by law, FluxPulse and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business interruption, even if advised of the possibility of such damages.
Service Modifications & Availability
We may modify or discontinue features or the Service at any time with reasonable notice. We do not guarantee that the Service will always be available or accessible; planned maintenance and unforeseeable outages may occur.
Term & Termination
You may terminate your account at any time. We may terminate or suspend your account if you violate these Terms or engage in illegal activity. Upon termination, we may delete your data in accordance with our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
